Account Terms
- Accounts registered by automated methods are not permitted.
- You must provide your legal full name, a valid email address, and any other information requested in order to complete the signup process.
- Your login may only be used by one person — a single login shared by multiple people is not permitted.
- You are responsible for maintaining the security of your account and password. Envisia cannot and will not be liable for any loss or damage arising from your failure to comply with this obligation.
- You are responsible for all content and activity that occurs under your account.
- You must not use the Service in violation of any laws in your jurisdiction (including, without limitation, copyright and data protection laws).
Cost of the Service
The TalentTools assessments are currently provided free of charge. We do not require payment or card details to create an account or to generate reports.
- If we introduce paid features in the future, we will make the price and terms clear before you choose to use them, and you will never be charged without your express agreement.
- We may change, add, or withdraw features of the Service at any time. We will give reasonable notice of any material change that affects how you use the Service.
Your Data and Content
- We claim no intellectual property rights over the material you provide to the Service. Your participant/respondent data remains yours.
- You are the data controller for the participant data you collect using the Service; we process it on your behalf to provide the Service. Our handling of personal data is described in our Privacy Policy.
- You are responsible for ensuring you have a lawful basis to invite participants and to process their responses.
- All content sent through the Service must comply with applicable copyright law.
- Envisia does not pre-screen content but has the right (not the obligation), in its sole discretion, to remove any content available via the Service.
Cancellation and Termination
- You may stop using the Service at any time. To close your account or request deletion of your data, email clientservices@envisialearning.com and we will action your request in line with our Privacy Policy.
- Once your account is closed, you will no longer be able to access your data.
- Envisia may, in its discretion, suspend or terminate your account and refuse current or future use of the Service for any reason, including a breach of these Terms. Termination may result in deactivation or deletion of your account and the content within it.
Acceptable Use
- You must not modify another website to falsely imply it is associated with the Service or Envisia.
- Without our explicit permission, you agree not to reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service.
- You must not transmit any worms, viruses, or code of a destructive nature.
- Verbal, physical, written, or other abuse (including threats) of any Envisia customer, employee, or officer may result in immediate account termination.
Warranties and Liability
- Your use of the Service is at your sole risk. The Service is provided on an “as is” and “as available” basis. We use reputable third-party vendors and hosting partners to provide the hardware, software, networking, and storage required to run the Service.
- Envisia does not warrant that the Service will meet your specific requirements, be uninterrupted, timely, secure, or error-free, or that results obtained will be accurate or reliable.
- To the fullest extent permitted by law, Envisia shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, including loss of profits, goodwill, use, or data, resulting from your use of or inability to use the Service. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.
General
- Our failure to enforce any right or provision of these Terms is not a waiver of that right or provision.
- These Terms constitute the entire agreement between you and Envisia regarding the Service and supersede any prior agreements.
- These Terms are governed by the laws of England and Wales, and you and Envisia submit to the exclusive jurisdiction of the courts of England and Wales.
